Rental Terms and Conditions
1. Definitions
1.1 In these conditions (unless the context otherwise requires):
- "Renter" means the person, firm or company with whom the Contract is made;
- "ClubKing" means ClubKing Limited;
- "Contract" means the contract between the Renter and the Company for the rental of Goods.
- "Goods" means the goods to be supplied pursuant to the Contract;
1.2 Words in the singular shall include the plural and vice versa, references to any gender shall include the others and references to legal persons shall include natural persons and vice versa.
1.3 The headings in these conditions are intended for reference only and shall not affect their construction.
2. Payment
When the Renter places an order through the ClubKing website they are agreeing to enter a contract with the following terms;
- An initial payment of either £278 Nett for a Medium Drum or £370 Nett for a Large Drum will be immediately taken once the order has gone through successfully. Included in this price is a 50% Security Deposit which is returned to the Renter once the drum has been returned.
- The Security Deposit of 50% (£139 Nett for Medium Drum and £185 Nett for a Large Drum) will be refunded back to the Renter’s original payment card once ClubKing has received back the drum and inspected it for any damage.
- ClubKing reserves the right to adjust the amount of monies refunded if the Drum has been found to be damaged in any way. The Renter will be altered by email if ClubKing finds any damage to the drum.
- ClubKing reserves the right to deduct £10 Nett from the monies refunded every time the courier is unable to collect the drum. ClubKing will ensure all the relevant contact details are on the label in case there is an issue with the courier. If the drum isn’t collected due to an issue with the Courier (e.g. Bad Weather) no monies will be deducted.
3. Rental Period
- The Rental period for the Drum is 48 hours only. To ensure the Drum is delivered to the Renter in time, ClubKing will have the drum delivered to Renter the day before the rental period starts. ClubKing will then arrange to have the drum collected the day after the rental period ends. For example if you needed the Drum for an event on a Wednesday, we would get the drum delivered to you on the Tuesday and collected on the Friday. If you require the drum for longer than 48 hours then please contact us so we can discuss your requirements.
4. Condition
- The Drum ClubKing will be supply the Renter with will not be brand new but is more than fit for purpose. There may be some minor cosmetic marks but nothing that affects the use of the drum. ClubKing expects each drum to be returned in the condition it was sent out in and keeps track of any cosmetic marks on the drum.
- ClubKing will provide the Renter with bespoke packaging that has been especially made to fit the drum and protect it during transport. Failure to return the drum in this packaging will result in £35 Nett being deducted from the monies refunded to the Renter.
- Upon return of the drum Clubking will fully inspect the drum to ensure there is no damage. Damage is defined by ClubKing as
- Cracks to the clear acrylic panels
- Chips to the clear acrylic panels
- Clear Panels that are broken into two or more pieces
- Visible damage to the metal frame including scratches and dents
- Missing Rubber Feet
- Missing Screws
iii. ClubKing reserves the right to charge the customer for any damage caused to the drum due to negligence and misuse. These charges will be subtracted from the Renters refund. A full report be sent to the Renter outlining the damage.
5. Damage caused by Courier
- If the Renter receives a drum that is damaged the Renter must immediately contact ClubKing. It can be obvious if the Drum has been damaged in transit as there will be visible damage to the box.
- Upon receipt of the drum, the Renter must photograph damage to the packaging, damage to the drum as well as the delivery label. This ensure ClubKing are able to file damage claim with the courier.
- ClubKing will then arrange for a replacement drum to be sent to the Renter in time for the event. If this is not possible due to time constraints the Renter will be refunded in full once the drum is returned back to ClubKing.
6. Collection and Delivery of Drum
- Delivery and Collection of the Drum is included in the price of the rental. The Renter must ensure an adult is present for both the delivery and collection of the drum.
- ClubKing will include the Renter’s contact details on the label to ensure they receive updates regarding the delivery and collection of the drum. Failure to ensure an adult isn’t present upon collection of the drum will result in a £10 Nett charge being deducted from the monies refunded to the renter. A further £10 Nett will be deducted for any further failed collections.
- If the Drum is not returned to ClubKing within 5 working days of the rental period ending without communication from the Renter, ClubKing reserves the right to keep all the monies paid by the Renter.
